Dear Tl’azt’en Nation Member:

On August 15, 2018, members of Tl’azt’en Nation voted in favour of separating Tl’azt’en Nation into two bands: Tl’azt’en Nation and Binche Whut’en.

Band Division Vote

Indigenous Services Canada (ISC) has been advised by the Electoral Officer that 190 Tl’azt’en Nation members voted in favour of separating and 150 Tl’azt’en Nation members voted against separating.

As a next step, Tl’azt’en Nation members are requested to choose whether they wish to remain a member of Tl’azt’en Nation OR whether they wish to be a member of Binche Whut’en. Please make your choice by completing the forms included in this package and providing the necessary supporting documentation.

Ministerial Order

After Tl’azt’en members choose membership in either Tl’azt’en Nation or Binche Whut’en, Indigenous Services Canada will send the results of the vote and membership choices to the Minister with a recommendation that the Minister create Binche Whut’en as a band and create new band lists for both Tl’azt’en Nation and Binche Whut’en. If the Minister agrees with this recommendation, the Minister will issue a Ministerial order which will create a new band, Binche Whut’en.

Choosing Your Membership

To create new band lists for Tl’azt’en Nation and Binche Whut’en, we require Tl’azt’en Nation members to fill out a Statement of Intent form. In the Statement of Intent, members can choose to remain a member of the Tl’azt’en Nation or choose to become a member of Binche Whut’en. If you do not submit a Statement of Intent by October 15, 2018, you will remain a member of Tl’azt’en Nation.

Adult

For an adult (18 years old and older), a fully completed Statement of Intent includes, at a minimum:

  • A signed Statement of Intent
  • Acceptable identification (only required if choosing Binche Whut’en)

Dependent Adult

For a dependent adult (18 years old or older), a fully completed Statement of Intent includes, at a minimum:

  • Statement of Intent signed by the adult with authority to act on behalf of the dependent adult
  • Acceptable identification of the parent or guardian (only required if choosing for the dependent adult to be a member of Binche Whut’en)

Child

For a child (under 18 years old), a fully completed Statement of Intent includes, at a minimum:

  • Statement of Intent signed by the parents identified on the child’s birth certificate unless there are other custody/guardianship arrangements
    • If there is a court order granting sole custody, guardianship or trusteeship of the child to the applying parent or legal guardian, you must provide copies of the legal documents. All custodial parents/legal guardians must sign the Statement of Intent.
  • Acceptable identification of the parent or guardian (only required if choosing for the child to be a member of Binche Whut’en)

In some circumstances, additional information may be required and additional documents are included with this package for this purpose. A Statement of Intent that is missing information or relevant documents may result in a request for further information.

Please note that you must submit one Statement of Intent form per person. If you wish to receive additional copies, please contact Stephen Chung (Stephen.Chung@canada.ca) or visit your band office.

If, at a later date, you or your child or a dependent adult wishes to transfer membership, you may apply to transfer to any Band, including Tl’azt’en Nation and Binche Whut’en. Please be advised there may be different and additional requirements if you choose to transfer your membership at a later date.
